Real estate law covers the laws and legal procedures that apply to residential and non-residential real estates – flats, houses, garages, plots of land, etc. In particular, in relation to real estate law, I undertake the transfer of real estate property, the drafting of sale and purchase agreements, donation contracts, the management of residential and commercial property leases, the drafting of lease agreements, the settlement of possession disputes, the legal evacuation of real estates, and general legal advice on real estate.
If the transfer of real estate is not a sale and purchase, the appropriate title should be determined in the first instance – for example, in intra-family transactions it is not always advisable to make a donation of the real estate for tax paying and inheritance related reasons. Once the appropriate title has been determined, the contractual structure is drawn up, followed by the execution of the contract and/or the fulfilment of the pre-conditions, such as the cancellation of encumbrances, obtaining official permits, pre-emption declarations, incorporation of banking requirements, as the case may be.
In the case of a lease, it is also advisable to have a contract written by a lawyer or a notarial declaration to avoid problems with termination, eviction and the recovery of any rent arrears or unpaid utility bills. Free sample contracts tend to work well as long as there is no dispute between the parties, if a tenant does not want to pay or move out, it quickly becomes apparent that the quality of the free samples is in direct proportion to the price paid for them.
