When does debt collection with a lawyer come into play? For example, if an invoice goes unpaid? If you have a debtor who fails to perform? The purpose of debt collection is to enforce your legitimate claims as quickly and cost-effectively as possible. Ideally without having to resort to lengthy and expensive litigation.

What Does Debt Collection with a Lawyer Mean in Practice?

Debt collection is not a single procedure but a process: from establishing the facts, through attempts at settlement, all the way to legal action if necessary. The first and most important step is always to assess the situation, examining the available evidence, the legal basis of the claim, and the debtor’s solvency. Based on this, it can be decided which approach is worth pursuing.

In most cases, everyone is better off if the dispute is resolved through settlement. Surprisingly often, a single attorney’s demand letter is enough to prompt the debtor to perform. The seriousness signaled by legal action alone increases the willingness to pay.

What Legal Tools Are Available for Debt Collection with a Lawyer?

If the attempt at settlement does not succeed, the following options come into play:

  • Attorney’s Demand Letter – the first and most affordable step, which often resolves the situation on its own
  • Order for Payment – a fast and cost-effective procedure in which the claim can be enforced before a notary, without court involvement
  • Civil Litigation – if the debtor disputes the debt or objects to the order for payment
  • Liquidation Proceedings – if the debtor company is insolvent and the claim can be enforced as a creditor’s claim

It’s important to know: not every procedure is worthwhile in every case. If the likelihood of successful collection is low, or the expected costs exceed the value of the claim, I will tell you so openly — and we will not pursue an unnecessary procedure. The cost shouldn’t exceed the value at stake — this is the principle I follow in every case.
