What Happens During Court Proceedings?

If a settlement cannot be reached, the matter proceeds to court. This involves several distinct stages: filing the statement of claim, exchanging submissions with the opposing party, attending hearings where evidence and arguments are presented, and ultimately receiving a judgment. Each stage requires careful preparation — a poorly drafted submission or a missed procedural deadline can weaken an otherwise strong case. Throughout the process, I keep you informed of realistic expectations, since litigation outcomes are rarely guaranteed and managing expectations is part of sound legal representation.

When Should You Involve a Litigation Lawyer?

The sooner, the better — ideally before the parties’ positions become entrenched. A litigation lawyer brought in early can often achieve a faster and less costly resolution out of court. If no settlement is reached, however, court proceedings remain, and throughout them I represent your interests from drafting the submissions through the hearings to the judgment.
